New Protections for Domestic Violence Victims

New protections are in effect for domestic violence victims in Tennessee under a newly enacted law.

Bond Conditions Changed

When someone is arrested for domestic violence a magistrate must now impose a 12-hour holding period, notify the victim, and issue a no-contact Order as a condition of release. Previously, those matters were left to the magistrate's discretion. Magistrates are also no longer required to issue temporary orders of protection.

Initial Court Appearance

Domestic violence victims no longer must appear in criminal court proceedings to testify at the initial hearing before a judge. Under the new law, police testimony is enough to push the case to the next stage. Many victims are scared of the alleged perpetrator and choose not to appear in court, which results in the charge being dismissed for failure to prosecute. This new law was created in an attempt to ensure those guilty of domestic violence are brought to justice.
