Due process allows an individual in the federal sphere to exercise his or her legal rights afforded by the U.S. Constitution and laws enacted by Congress. In immigration court, it allows one to contest the proposed deportation by appearing before a judge.

Courts have held time and time again that anyone on United States soil is protected by the Constitution’s right to due process, even if they entered unlawfully. All immigrants, undocumented or those lawfully present, can be placed in deportation proceedings. The right to due process gives them the ability to fight their removal proceedings, be represented by a lawyer, present testimony and evidence, and appeal an unfavorable decision to the Board of Immigration Appeals and to the federal circuit courts of appeal.
